Buying Property in Israel: Why Legal Due Diligence Is Essential

Buying property in Israel can be an attractive investment, whether you plan to live there, purchase a second home or invest. However, before signing a contract, it is essential to conduct thorough legal due diligence.

The first step is to verify the seller’s rights. In Israel, property rights may be recorded in the land registry (Tabou), administered by the Israel Land Authority or recorded in the registers of a company responsible for managing those rights. The lawyer must verify the seller’s legal capacity to transfer the property, as well as the existence of any mortgages, attachments, encumbrances or third-party rights.

The property’s planning status and building permits should also be examined. Unauthorized work or extensions can have significant legal and financial consequences.

The contract must address, among other matters, the payment schedule, the discharge of any mortgage, the handover of possession, tax obligations and the transfer of rights. Where possible and appropriate, a warning notice (He’arat Azhara) should be registered to protect the buyer’s contractual rights until the transaction is completed.

Key takeaway: legal due diligence is not a mere formality. Engaging an independent lawyer before signing any documents can help prevent costly disputes and safeguard your investment.
